Introduction

This Privacy Policy (“Policy”) explains how your (“you,” and “your) Personal Information (defined below) is collected, used, shared, and processed by Pratt Industries, Inc., and its subsidiaries and affiliated companies (collectively, “ the Company,” “Pratt,” “Pratt Industries,” “we,” “us,” and “our”) via interactions with our websites or any other Pratt  website or link referring back to this Privacy Policy (“Websites,”), or via data collected via our underlying products and services (collectively, the “Services”). Personal information includes information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household, as defined by applicable privacy laws and does not include data that has been effectively irreversibly anonymized or aggregated so that it can no longer enable us or others, whether in combination with other information or otherwise, to identify an individual (“Personal Information”).

Policy Modification: We may change this Policy from time to time, to reflect how we process your data, and if we make changes, we will revise the last modified date at the top of this Policy. If we make changes that materially affect your privacy rights, we will attempt to provide advanced notice (in nearly contemporaneous disclosures) or otherwise via the Services, or by some other means of contact so that you have a reasonable opportunity to review the changes before you continue to use the Services.  If you do not agree with a future, modified version of this Policy, then please stop using the Services at such future time.

  1. How We Collect and Use Your Personal Information

a.       Information provided by you.

We collect certain Personal Information when you use the Services for example, to request information, browse the Services, register on our Websites, purchase Services, take part in subscribe to our newsletter, respond to a survey, or post content and materials to the Services:

  • Contact Information, including name, shipping address, billing address, phone number, company name, and email address, and other contact methods you provide to us;

Please note: When communicating with us (whether by text message, email, or through the Services or other means), please do not send us any sensitive information pertaining to yourself or others. We do not intend to collect or store sensitive information or special categories of information.

b.       Information automatically collected by the Services.

We may use cookies, tags, web pixels, and similar technologies to automatically collect information on our Services. Information within this section describes our use of these technologies and your ability to control the use of these technologies.

  • Cookies are small web files that a website or its provider transfers to your device’s hard drive, through your web browser, that enables the site’s or provider’s system to recognize your browser and remember certain information.  “First-party cookies” are cookies set by us on the Services. “Third-party cookies” are cookies set by other companies whose functionality is embedded into our Services (for example, those set by Google).  Generally, we may use first-party and third-party cookies for the following purposes: to make our Services function properly; to provide a secure browsing experience during your use of our Services; to collect passive information about your use of our Services; to measure how you interact with our marketing campaigns; to help us improve the Services; and to remember your preferences for your convenience.
  • Web Pixels. To see how successful our marketing campaigns or other goals of the Services are performing, we may use conversion pixels, which fire a short line of code to tell us when you have clicked on a particular button or reached a particular page. We may also use web pixels to analyze usage patterns on our Services. The use of a pixel allows us to record that a particular device, browser, or application has visited a particular webpage.
  • We may use third-party service providers to monitor and analyze the use of our Services, such as Google Analytics.  Such service providers often have their own separate privacy practices.
  • Behavioral Remarketing. We may also use remarketing services to advertise on third-party websites to you after you visit the Services. For this purpose, visitors are grouped by certain actions on the Services, e.g., by duration of a visit. This enables us to understand your preferences and to show you personalized advertising even if you are currently surfing on another website that also participates in the same advertising network. We may utilize Google Ads, and similar ad networks.
  • Java Script. Pages of our Services may also use Java scripts, which are code snippets embedded in various parts of websites and applications that facilitate a variety of operations including accelerating the refresh speed of certain functionality or monitoring usage of various online components; entity tags, which are HTTP code mechanisms that allow portions of websites to be stored or “cached” within your browser to accelerate website performance; and HTML5 local storage, which allows data from websites to be stored or "cached" within your browser to store and retrieve data in HTML5 pages when the website is revisited.
  • Other Tracking Technologies. We may also use tracking technologies to collect "clickstream" data, such as the domain name of the service providing you with internet access, your device type, IP address used to connect your computer to the internet, your browser type and version, operating system and platform, the average time spent on our Services, pages viewed, content searched for, access times and other relevant statistics, and assign unique identifiers to the device or other credentials you use to access the Services for the same purposes.
  • Do Not Track. Some browsers have a “Do Not Track” (DNT) feature that lets you tell websites and online services that you do not want to have your online activities tracked. Such browser features and industry standards are not uniform. As such, we do not monitor or respond to DNT browser requests.  If a standard is adopted that we must follow in the future, then we will inform you about that practice in a revised version of this Policy.
  • Location Information. You may be able to adjust the settings of your device so that information about your physical location is not sent to us or third parties by (a) disabling location services within the device settings; or (b) denying certain websites or mobile applications permission to access location information, by changing the relevant preferences and permissions in your device or browser settings.
  1. Your Choices. Your browser may provide you with the option to refuse some or all browser cookies. You may also be able to remove cookies from your browser. You can exercise your preferences in relation to cookies on the Services by taking steps outlined below.
  • First-Party CookiesYou can use the browser with which you are viewing the Services to enable, disable or delete cookies. To do this, follow the instructions provided by your browser (usually located within the "Help", "Tools" or "Edit" settings). Please note, if you set your browser to disable cookies, you may not be able to access certain secure areas of the Services.   • Google Analytics. We use Google Analytics on our Services to help us analyze traffic and improve services.   • Google Ads. Our Services also use the Google AdWords remarketing service to advertise on third party websites (including Google) to previous visitors to our Services. That could mean that we advertise to previous visitors who haven’t completed a task on our site. This could be in the form of an advertisement on the Google search results page or a site in the Google Display Network. Third-party vendors, including Google, use cookies to serve ads based on someone’s past visits to our sites. Any data we collect will be used in accordance with this Policy, and Google is responsible to abide by its own privacy policy.   • Social Media & Search Pixels. We use Meta Pixel tags and other social media and search pixels to better measure, optimize, and retarget our marketing campaigns. This allows user-specific behavior to be tracked after the user has been redirected to the advertiser’s website by clicking on a social media or search ad. This enables us to measure the effectiveness of social media and search ads for statistical and market research purposes. The data collected in this way is anonymous to us, in other words, we do not see the Personal Information of individual users. This data is stored and processed by the social media and search providers. The social media and search providers may link this information to your social media or search account and also use it for its own promotional purposes, in accordance with their data usage policies.  For more information, please visit:
  • Unsubscribing from Marketing Communications. If you do not want us to use your email account to send you marketing emails or non-transactional promotional materials, please directly click on the unsubscribe link at the bottom of any of our email messages to you.
  1. Purpose of Collection of Personal Information

We may process your Personal Information for the following purposes:

  • To provide and administer the Services and any related or underlying services to you;
  • To fulfill a service to you. For example, if you email us a question, we may use your email address to process your request and respond to your question;
  • To publish testimonials on our Services;
  • To monitor and analyze trends and aggregate information;
  • To protect and prevent against fraud and misuse of the Services;
  • To send updates, newsletters and notifications to you relating to the Services and underlying services, special events, or contests;
  • To facilitate our business operations;

  1. Sharing Your Personal Information

Except as otherwise described in this Policy, we will not sell Personal Information that we collect from the Services to any third party for monetary or other valuable consideration, unless notice has been provided and only with your consent:

  • Subsidiaries and Affiliates. We disclose your Personal Information among the Pratt Industries family, and its current affiliates and subsidiaries, for business purposes to help us provide the Services and to support business operations, including marketing, analytics, security, and advertising.
  • Service Providers & Contractors. To help us provide superior service, your Personal Information may be shared with our service providers, contractors, and other third parties we use to support our business. Such third parties may help us with aspects of our business such as fraud prevention, providing customer service, maintaining and analyzing data, sending customer communications on our behalf, and entry collection, winner selection and prize fulfillment for contests, sweepstakes, and other promotions.
  • Analytics & Advertising Partners. We may share your Personal Information, including without limitation your contact information, with entities that perform marketing or data aggregation services on our behalf. We may share Personal Information, including without limitation your device information, location, usage data, and IP address, to analytics-based technologies to assist with personalization, advertising, and marketing.  These technologies capture how you interact with our Services through behavioral metrics to improve and market our underlying services, products, and Services.
  • Authorized Representatives. If another individual is managing your relationship with us or your email account which the Services connect to on your behalf (for example, a manager controlling the department relationship), as authorized by you or as a personal representative under applicable law, that person can view all Personal Information about you on the Services.
  • In the Event of Merger, Sale, Divestitures, or Change of Control. We reserve the right to transfer Personal Information to a buyer or other successor in interest that acquires rights to that information as a result of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of us or substantially all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by us about you is among the assets transferred.
  • With Your Consent. We may share your Personal Information for other purposes pursuant to your consent or at your direction. 
  • Other Disclosures. We may disclose your Personal Information if we have a good faith belief that disclosure of such information is helpful or reasonably necessary to: (i) conform to legal requirements and comply with any court order, law, or legal process, including responding to any government, law enforcement, or regulatory request; (ii) enforce our Terms of Use, other agreements, including between you and us, and any other documents included or referenced therein (all of which are incorporated into and made a part of this Policy by reference); (iii) fulfill the purpose for which you provide it; (iv) detect, prevent, or otherwise address fraud or security issues; or (v) protect against harm to our, your, or third parties’ rights, property, or safety.

We may share and disclose de-identified and/or aggregate analytics with third-party partners for any legal purpose, including, when and where applicable, sharing and disclosing non-personally identifiable information combined with Personal Information.

  1. Third Party Advertisers

Please note that we may share information with advertisers. We permit third party advertisers ("Third-party Advertisers") to place tags, scripts, and beacons ("Third-party Tags") on our Services as part of the advertisements displayed on our Services. These Third-party Tags may set cookies on your device and also may gather information about your device and the pages you visit on our Services and on other websites that display Third-party Tags. You should review the privacy policies and notices of our Third-party Advertisers for more information about how they use the information gathered through Third-party Tags. We take information security very seriously and use reasonable administrative, technical, and physical measures to protect your Personal Information from unauthorized access. Unfortunately, no security system can be guaranteed to be 100% secure. Accordingly, we cannot guarantee the security of your information and cannot assume liability for improper access to it.

  1. Retention

We may retain your Personal Information, including any correspondence you have with us, for as long as is necessary for the purposes set out in this Policy, including retaining Personal Information to comply with our legal obligations, to resolve disputes, for information security purposes, and to enforce our legal rights, terms, or policies.

  1. Third-Party Websites

The Services may contain links to third-party services, websites, mobile applications, and/or contain advertisements from third parties that are not affiliates with us – and which may link to other websites, services, or applications. While we endeavor to work with third parties that share our respect for user privacy, we are not responsible for the privacy policies or privacy practices of such third parties. Any information collected by third parties are not covered by this Policy. You are responsible for knowing when you are leaving the Services to visit a third-party website, service, or application and for reading and understanding the terms of use and privacy policy statements for each such third party.

  1. Social Media

Any information, communications, or material of any type or nature that you submit via public sites (including, but not limited to any social media platforms or websites such as Facebook, Instagram or X) by email, posting, messaging, uploading, downloading, or otherwise (collectively, a “Submission”), is done at your own risk and without any expectation of privacy. We cannot control the actions of other users of any social media platform or website, therefore, we are not responsible for any content or Submissions contained on such social media platforms and website. By visiting the public sites contained on a social media platform or website, you are representing and warranting to us that you have reviewed the applicable privacy policy and terms of use of such platform or website and that you will abide by all such provisions contained therein.

  1. Children

The Services and our underlying products and services are not directed to, and we do not knowingly collect Personal Information from, children under the age of 13 or minors (as defined by applicable laws). If you are a minor, please do not attempt to fill out our forms or send any Personal Information about yourself to us. If a minor has provided us with Personal Information without parental or guardian consent, the parent or guardian should contact us immediately to remove the relevant Personal Information and unsubscribe the minor.  If we become aware that a minor has provided us with Personal Information, we will take steps to promptly delete such Personal Information from our files.

  1. Extraterritorial Transfers of Personal Information

The Services are hosted in the United States.  Please also note that if you are providing data or using our Services from outside of the United States, your Personal Information will be accessed and transferred to the United States.  The United States may have data protection laws that are less protective than the laws of the jurisdiction in which you reside.  For such data transfers, we rely on your consent.  If you do not want your information transferred to, processed, accessed, or maintained in the United States, then you should immediately cease accessing the Services.

  1. Regional Privacy Rights

This section is applicable to residents of the below mentioned states, as applicable, which provide residents with certain rights regarding Personal Information (“consumers” or “you”). This section uses certain terms that have the meaning given to them in each state’s privacy law, as applicable, including ‘Personal Information’, which shall be used interchangeably with privacy laws that similarly define ‘Personal Data’. The following do not apply to individuals who do not live in these states on a permanent basis.

I. SHINE THE LIGHT

Under California Civil Code Section 1798.83 (“Shine the Light”), California residents have the right to request in writing from businesses with whom they have an established business relationship, (a) a list of the categories of Personal Information, such as name, e-mail and mailing address and the type of services provided to the customer, that a business has disclosed to third parties (including affiliates that are separate legal entities) during the immediately preceding calendar year for the third parties’ direct marketing purposes; and (b) the names and addresses of all such third parties. II. CALIFORNIA CONSUMER PRIVACY ACT OF 2018, AS REVISED AND UPDATED BY THE CALIFORNIA PRIVACY RIGHTS ACT (COLLECTIVELY, “CCPA”)

A. Collection, Disclosure, and Retention of Personal Information

The Personal Information we collect and the sources from which we collect, disclose information, and retention information are described in the above sections of this Privacy Policy.

B. Selling and Sharing Personal Information

We do not sell or share your Personal Information in exchange for monetary consideration. However, the definitions of Personal Information, ‘share,’ and ‘sale’ under CCPA are broad.  The CCPA defines “sharing” as providing Personal Information to a third party for cross-context behavioral advertising, whether or not for money or other valuable consideration.  We may share your Personal Information with a third party to help serve personalized content or ads that may be more relevant to your interests, and to perform other advertising-related services such as enabling our partners to serve such personalized content.

C. CCPA Consumer Rights

Under CCPA, consumers have certain rights regarding their Personal Information, as described below.

  • Right of Access: You have the right to request, twice in a 12-month period, that we disclose to you the following information about you, limited to the preceding twelve (12) months:
    • The categories of Personal Information that we collected about you;
    • The categories of sources from which the Personal Information is collected;
    • The business or commercial purpose for collecting or selling Personal Information;
    • The categories of third parties with whom we share Personal Information;
    • The specific pieces of Personal Information that we have collected about you;
    • The categories of Personal Information that we disclosed about you for a business purpose or sold to third-parties; and
    • For each category of Personal Information identified, the categories of third parties to whom the information was disclosed or sold.
  • Right of Deletion: You have the right to request that we delete any Personal Information about you which we have collected from you, subject to exceptions within the law.
  • Right to Opt-Out: You have the right to opt-out of the disclosure of Personal Information about you for monetary or other valuable consideration. However, we do not sell your Personal Information in exchange for monetary consideration. We may use tools described above such as Google Analytics, which may be interpreted as sharing your Personal Information.  As such, please see the above YOUR CHOICES section for more information regarding opting out of the use of these tools.
  • Right to Opt-In: We do not have actual knowledge that we collect, share, or sell the Personal Information of minors under the age of 16 without proper consent of a parent or guardian.
  • Right to Limit Use and Disclosure of Sensitive Personal Information: You have the right to request specific limitations on further sharing, use, or disclosure of your Sensitive Personal Information that is collected or processed for certain reasons outside of providing the Services. However, we do not collect or process Sensitive Personal Information for any of these reasons.
  • Right to Correction: You have the right to request that we maintain accurate Personal Information about you and correct any Personal Information about you which we have collected from you, subject to exceptions within the law.

III. NEVADA PRIVACY RIGHTS

We comply with the requirements of the Nevada Privacy law, which in some instances provides residents with choices regarding how we share information. Nevada Covered Personal Information ("Nevada PI") includes personally identifiable information about a Nevada consumer collected online, such as an identifier that allows the specific individual to be contacted. Nevada PI also includes any other information about a Nevada consumer collected online that can be combined with an identifier to identify the specific individual. We may collect the following categories of covered information about you through our Services:

  • First and Last Name
  • Physical Address
  • Email Address
  • Telephone Number

We may share such covered information with categories of third-parties including marketing. Third-parties may collect covered information about your online activities over time and across different Internet websites or online services when you use our Services.

You have the right to request that we not sell your Personal Information. Although we do not currently sell Personal Information, you may submit a request directing us to not sell Personal Information if our practices change in the future.

IV. CONSUMER REQUESTS AND VERIFICATION

 A. Right to Non-Discrimination

We may not discriminate against you because you exercise any of your privacy rights contained in this Privacy Policy including, but not limited to:

  • Denying goods or services to you;
  • Charging different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties;
  • Providing a different level or quality of goods or services to you; or
  • Suggesting that you will receive a different price or rate for goods or services or a different level or quality of goods or services.

B. Verifying Requests

You may request to exercise your rights of access, deletion, or correction by contacting us as described in the CONTACT US section below. To help protect your privacy and maintain security, we will take steps to verify your identity before processing your request.  If you request access to or deletion of your Personal Information, we may require you to provide any of the following information: name, email address, telephone number, or postal address. When you make such a request, you can expect the following:

  • As required under applicable law, we will verify your identity. You will need to provide us with your email address and full name. We may ask for additional information if needed.
  • We will confirm that you want your information accessed, corrected, and/or deleted.
  • We will confirm our receipt of your request within 10 days. If you have not received a response within a few days after that, please let us know by contacting us at the webpage or phone number listed below.
  • We will respond to your request within 45 days upon receipt of your request. If necessary, we may need an additional period of time, up to another 45 days, but we will reply either way within the first 45-day period and, if we need an extension, we will explain why.
  • In certain cases, a request for access, correction, or deletion may be denied. For example, if we cannot verify your identity, the law requires that we maintain the information, or if we need the information for internal purposes such as providing Services or completing an order. If we deny your request, we will explain why we denied it and delete any other information that is not protected and subject to denial.

C. Authorized Agents

You may designate an authorized agent to request any of the above rights on your behalf. You may make such a designation by providing the agent with written permission, signed by you, to act on your behalf. Your agent may contact us as described in the CONTACT US section below to make a request on your behalf. Even if you choose to use an agent, we may, as permitted by law, require:

  • The authorized agent to provide proof that you provided signed permission to the authorized agent to submit the request;
  • You to verify your identity directly with us; or
  • You to directly confirm with us that you provided the authorized agent permission to submit the request.
